Limited Warranty: This limited warranty is provided by Market Group ventures, Inc (“Seller”) to the original purchaser of the PLED LED lighting Product (“Product”). This limited warranty may be transferred to subsequent purchasers of the Product, provided that such Product is resold in new condition and in its original packaging. Seller warrants that the Product will be free of defects in material and workmanship for a period of THREE years from the date of original purchase. The Limited Warranty is subject to these Terms and Conditions. The Seller will, in its discretion, replace or repair the Product as per the Warranty Claim Procedure.

Warranty Claim Procedure: If any product does not conform to this limited warranty, the purchaser shall notify Seller in writing to the address below within (30) days of the discovery of the defect and provide proof of purchase, and comply with Seller’s other warranty requirements. The Seller shall provide the Purchaser with a Return Material Number (RMA) and instructions as to if, when and where to return defective Product. Purchaser must promptly return Product, at Purchaser’s expense, to Seller in accordance with such instructions. Seller reserves the right to (i) examine all Product to determine the cause of failure and patterns of usage and (ii) be the sole judge as to whether a Product is defective and covered underwarranty.

Terms and Conditions: This Limited Warranty only applies when Product is properly installed and used in accordance with Seller’s published specifications and operating instructions. Product must be used in lighting equipment designed and approved for the application and in environmental conditions within the normal specified operating range. The LED arrays in the Product will be considered defective in material or workmanship only if 15% or more of the individual LED’s in such Product fail to illuminate. This Limited Warranty does not apply to loss or damage to the Product caused by: negligence; abuse; misuse; mishandling; improper installation, storage or maintenance; failure to install the Products in applications where ambient temperatures are within the range of -20C (-10F) and +30C (90F) or temperature at control point (Tc) over 75C (180F);fire; acts of God; vandalism; civil disturbances; power surges or dips; improper power supply; electrical current fluctuations; excessive switching; corrosive environment installations; induced vibration; alteration; the fault or negligence of any third party not engaged by Seller; the failure to comply with any applicable electrical or building codes; or any other causes or occurrences beyond Seller’s reasonable control. Seller shall in no event be responsible under this limited warranty for any deterioration, corrosion or discoloration of the Product. Any repair, alteration or modification of Product will void the limited warranty in its entirety. Sellers obligation under this Limited Warranty will be limited to the furnishings of new or refurbished units, in exchange for Product proven to be defective and does not include any other costs of removal, installation or shipping.

Limitation of Liability: The foregoing Limited Warranty provisions are exclusive and are given and accepted in lieu of any and all other warranties, whether expressed or implied, including without limitation any warranty against patent infringement and any implied warranties of merchantability or fitness for a particular purpose. In no event shall seller be liable for incidental, compensatory, consequential, indirect, special or other damages. Seller’s aggregate liability with respect to a defective product shall in any event be limited to the monies paid to Seller for that defective Product.
